Terms and Conditions – Alexander Lorenzi
1. Definitions
- Consumer: a natural person acting outside the scope of their profession or business.
- Entrepreneur: Alexander Lorenzi, Chamber of Commerce 92290558, info@alexander-lorenzi.com.
- Distance Agreement: a purchase made via a system organized by the entrepreneur without physical meeting.
- Right of Withdrawal: the consumer’s right to cancel the agreement within the reflection period (14 days).
2. Applicability
- These terms apply to all offers, orders, and distance agreements.
- In case of conflicting terms, the provision most favorable to the consumer applies.
3. Offer and Agreement
- Offers are non-binding, may be amended, and include product information, price, shipping costs, and withdrawal rights.
- The agreement is concluded when the consumer accepts the offer and makes payment.
- For electronic purchases, the entrepreneur confirms receipt immediately.
4. Right of Withdrawal and Returns
- Consumers may cancel within 14 days without giving a reason.
- Products must be returned undamaged, complete, and in their original packaging.
- Return costs are the consumer’s responsibility. Refunds are made within 14 days after receipt.
- Certain products/services are excluded from withdrawal (e.g., custom-made items, hygiene products, digital goods).
5. Prices
- Prices include VAT and are subject to typographical errors.
- Price changes within three months are only allowed due to legal regulations; thereafter only if agreed.
6. Conformity and Warranty
- Products must comply with the agreement, specifications, and legal requirements.
- Warranty does not affect statutory rights.
- Damage caused by misuse or third-party repair is not covered.
7. Delivery
- Delivery is to the address provided by the consumer, within 30 days unless otherwise agreed.
- Risk of damage or loss lies with the entrepreneur until delivery to the consumer.
- If delivery is impossible, a replacement product may be offered.
8. Duration Agreements
- Agreements for an indefinite period may be terminated at any time with a maximum one-month notice, unless agreed otherwise.
- Certain fixed-term agreements (e.g., magazines) may be automatically extended in limited cases.
9. Payment
- Payments are due within 7 days unless otherwise agreed.
- Any errors in payment information must be reported immediately.
10. Complaints
- Complaints must be submitted in writing within 7 days of discovery.
- The entrepreneur responds within 14 days and may resolve via repair or replacement.
11. Disputes
- Dutch law applies to all agreements, even if the consumer resides abroad.
